§ 1 Provider and scope
The provider of the website avtoshteta.bg and contracting party is ВИТТАЛИ КРАФТ ЕООД (VITTALI KRAFT EOOD), UIC (ЕИК) 203865381, VAT no. BG203865381, registered office at ул. „България“ 1, ет. 4, офис 409, 9300 гр. Добрич, Bulgaria, represented by its managing director (управител) Динчер Хаджиев. These Terms and Conditions apply to all contracts for the preparation of an online repair cost estimate that customers conclude via avtoshteta.bg.
Customers within the meaning of these Terms are consumers and businesses. Provisions that apply only to consumers are marked as such.
§ 2 Service
The Provider prepares a calculation of the expected repair costs of damage to a vehicle (cost estimate). It is based exclusively on the photos and information uploaded by the customer.
The vehicle is not inspected. Hidden damage, damage not visible in the photos and consequential damage cannot be recorded. The actual repair costs may therefore differ.
The calculation is made with a professional calculation system based on original spare parts, manufacturer labour times and usual local garage rates.
The cost estimate is not an expert report and not a valuation within the meaning of the Bulgarian Independent Appraisers Act (Закон за независимите оценители). It makes no statement on replacement value, residual value, diminution in value or how the accident happened, and no legal assessment. [OPEN: lawyer – check the term „калкулация“ vs. „оценка“ and the distinction from the ЗНО.]
The cost estimate is sent as a PDF by e-mail to the address given by the customer.
§ 3 Packages, prices and deadlines
Cost estimate: €79, sent within 48 hours.
Express: €99, sent within 24 hours.
All prices are final prices in euros including 20 % value added tax (ДДС). There are no further costs. The customer receives an invoice showing the tax.
Deadlines count working days only (Monday to Friday, excluding public holidays in Bulgaria). They only begin when both conditions are met: the payment has been received in the Provider's account, and all required photos are available in usable quality.
§ 4 Conclusion of the contract
The presentation of the services on the website is not a binding offer.
Ordering process: the customer chooses a package, enters their details and the vehicle data, uploads the photos and confirms the notices. Before sending, they can check and correct all entries. By clicking “Order with obligation to pay” they submit a binding offer.
The contract is concluded when the Provider confirms the order by e-mail. The confirmation contains the order number, the amount and the bank details.
The contract language is Bulgarian. The contract text is stored by the Provider. The customer receives the order details and these Terms by e-mail. [OPEN: add the Terms as attachment/link to the confirmation e-mail.]
§ 5 Payment
Payment is made in advance by bank transfer to the account stated in the confirmation. The order number must be given as the payment reference.
An instant transfer (SEPA Instant) is recommended so that processing starts quickly.
If payment is not received within 10 days of the order, the Provider may cancel the order. The uploaded data is then deleted.
§ 6 Customer's cooperation
The customer uploads all required photos in accordance with the photo guide and provides true and complete information.
If photos are incomplete, blurred or unusable, the Provider requests them again by e-mail. The customer submits them via the link sent. The deadline is suspended until then.
The customer warrants that they may use the photos and that the photos do not infringe any third-party rights.
The Provider is not liable for errors in the cost estimate that result from incorrect or incomplete information or photos from the customer.
§ 7 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of 14 days from conclusion of the contract (Art. 50 et seq. ЗЗП). Details are set out in the withdrawal information.
The right of withdrawal expires when the Provider has fully performed the service and the consumer, when ordering, expressly agreed that performance would begin before the end of the withdrawal period and acknowledged that they thereby lose their right of withdrawal (Art. 57 item 1 ЗЗП).
If the consumer withdraws after work has begun but before the cost estimate has been sent, they owe a proportionate amount for the service already provided. [OPEN: lawyer – calculation of the partial amount.]
§ 8 Defects and complaints
If the cost estimate contains obvious errors (for example wrong vehicle, a damaged part clearly visible in the photos was omitted, calculation error), the Provider corrects it free of charge.
The customer sends complaints by e-mail to with the order number and a description. The Provider responds within 14 days.
Differences between the cost estimate and a later garage invoice are not a defect insofar as they are due to non-visible damage, price changes or a different repair method.
The statutory rights of consumers remain unaffected.
§ 9 Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health.
In the case of slight negligence, liability is limited to foreseeable, typical damage, at most the order value. [OPEN: lawyer – admissibility towards consumers under the ЗЗП.]
The Provider is not liable for decisions that third parties make on the basis of the cost estimate (for example insurers, garages, buyers).
§ 10 Copyright and use
The customer may use the cost estimate for their own purposes and pass it on to an insurer, garage or lawyer. Public distribution or commercial exploitation is not permitted.
§ 11 Data protection
Personal data and photos are processed only to perform the contract. Details are set out in the Privacy Policy.
Retention period:
Photos and uploaded documents are deleted 12 months after the cost estimate has been sent, so that complaints and queries (for example from insurers) can be handled.
For cancelled, unpaid orders, all data and photos are deleted immediately after cancellation.
Invoicing and accounting data are kept for as long as Bulgarian tax and accounting law requires. [OPEN: lawyer/tax adviser – insert the exact statutory period.]
§ 12 Dispute resolution
In the event of disputes, consumers may contact the Bulgarian Commission for Consumer Protection (КЗП) and use the conciliation committees under the ЗЗП. [OPEN: lawyer – add the mandatory information on alternative dispute resolution and the competent conciliation body.]
Bulgarian law applies. Mandatory consumer protection provisions of the country in which a consumer has their habitual residence remain unaffected.
§ 13 Changes and final provisions
A contract is governed by the version of the Terms published at the time of the order.
If individual provisions are invalid, the remainder of the contract remains valid.
